Privacy

Raise Learning Pty Ltd’s privacy statement applies to the use of this site. Special provision additional provision with regard to early childhood services using LIFT: In order to use LIFT, early childhood services must comply with the privacy act. This includes but is not limited to making sure they have a privacy policy that complies with the 11 Information Privacy Principles in the Privacy Act 1988: 1. Clearly informs families that online services like LIFT will be used for the collection and storage of key information about their child and their child's development; 2. informs parents of how you will collect and collate this information; 3. informs parents how you will ensure that only persons with explicit permission (eg. staff) will have access to their child's information 4. informs parents of how images will be shared, clearly giving parents the choice whether their child's images can be shared with other families at the service - important where the photographs are used in the shared 'programs area' of LIFT. 2. Informs parents of their rights to access, amend and/or remove information from LIFT.

Payment policy |
All invoices are billed with strict 14 day payment terms. Raise Learning reserves the right to change the pricing of any of its products at any time. Notification of this pricing change shall be at http://www.raiselearning.com.au/pages/pricingplans. For new customers, price increases are applicable immediately. For existing customers price increase are only applicable at the end of their invoiced term. A late fee of 10% will be incurred for failure to remit payment for services on or before the required 14 days after an invoice has been issued. Failure to remit payment for 30 days, shall result in a termination of public access to Customer services. Failure to remit payment for services within 60 days of non-payment shall result in termination of access to the service network and all services shall be reclaimed. Raise Learning Pty Ltd accepts the following payment methods: - direct bank deposit (banking details for deposit of your payment are provided on your invoice and/or can be requested by telephone and email); - cheque (Raise Learning retains the rights to bill customers for cancelled/overdrawn cheque bank charges and fees); or - credit card using done via 3rd party International Creditcard merchant.

Refund policy |
Customers of Raise Learning may request a refund up 14 days after invoicing. Raise Learning Pty Ltd enters into a Terms of Service agreement with customers that provides for ongoing service delivery and warranty provisions. Under the Terms of Service, where Raise Learning Pty Ltd is unable to rectify services provided, customers are entitled to a full refund of the unused part of their Raise Learning Pty Ltd subscription. |
Cancellation policy |
If for any reasons you to wish to cancel any services Raise Learning Pty Ltd requires a thirty (30) day formal cancellation notice PRIOR to the renewal billing date for discontinuance or downgrades of services. Please note that cancellation of a service can only be performed by an approved administrator of an account. The cancellation must be in writing on the letterhead of that customer/organisation or from the email registered to that administrator. Customers must follow Raise Learning Pty Ltd's cancellation requirements above to provide an effective notice of cancellation. |
Limitation of liability |
Except where prohibited by law, in no event will Raise Learning Pty Ltd be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if Raise Learning Pty Ltd has been advised of the possibility of such damages. |
Indemnification |
You agree to indemnify and hold Raise Learning Pty Ltd, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including legal fees), made against Raise Learning Pty Ltd by any third-party due to or arising out of or in connection with your use of the site and or services. |
Violation of these Terms of Use |
Raise Learning Pty Ltd may preserve any transmittal or communication by you and may disclose this information if reasonably necessary to comply with legal process, enforce these terms of use, or protect the rights, property, and safety of Raise Learning Pty Ltd and related parties. |
Transfer and choice of law

You may not assign, delegate or otherwise transfer this agreement or any of your rights and obligations hereunder without Raise Learning Pty Ltd prior written consent. |
Applicable Law

This agreement is entered into in the State of Victoria, Australia, and you agree that all matters relating to your access to or use of the site, including all disputes, shall be governed and construed in accordance with the laws of the State of Victoria, and waive any objection to such a jurisdiction or venue. |
